1. Service Description

My IT Guy ("the Service") provides each customer with a dedicated AI agent that builds, manages, and extends websites and related infrastructure. The Service is operated by Hypertrail ("we", "us", "our").

2. AI-Powered Service

The Service is powered by artificial intelligence. AI-generated code, configurations, and deployments are provided on an "AS IS" and "best effort" basis. We make no warranties regarding the accuracy, completeness, reliability, or suitability of AI-generated output. You are solely responsible for reviewing all agent output before using it in production.

3. No Service Level Agreement

The Service does not come with any uptime guarantees or service level agreement (SLA). We do not guarantee response times, availability, or uninterrupted operation of your dedicated agent or any deployed infrastructure.

4. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from:

  • AI agent errors, incorrect code, or misconfigurations
  • Website or infrastructure downtime
  • Data loss or corruption
  • Security vulnerabilities introduced by AI-generated code
  • Any actions taken by your dedicated AI agent

5. Customer Responsibilities

You agree to:

  • Review all AI agent output before approving it for production use
  • Maintain your own backups of critical data
  • Not use the Service for illegal or harmful purposes
  • Not attempt to circumvent usage limits or security controls

6. Interaction Limits

Each plan includes a monthly limit on the number of interactions (messages) you can send to your AI agent. Interaction counts reset at the start of each billing period. Once you reach your monthly limit, you will need to upgrade your plan or wait for the next billing period to continue sending messages.

AI services are provided through third-party providers who may, at their discretion, throttle or rate-limit usage during periods of high demand. We are not responsible for delays, reduced performance, or temporary unavailability caused by third-party AI provider throttling.

7. Billing & Refunds

Subscription fees are charged immediately upon signup and then monthly while your agent is active. If you cancel your subscription, you will receive a pro-rata refund for the unused portion of the current billing period. We reserve the right to change pricing with 30 days notice.

8. Termination

We reserve the right to terminate your account and agent at any time, for any reason, with or without notice. Upon termination, your dedicated agent will be shut down and associated infrastructure will be decommissioned. A pro-rata refund will be issued for the unused portion of your billing period.

9. Data & Privacy

Your AI agent operates in a shared AWS account with tag-based isolation. While we take reasonable measures to isolate customer resources, we do not guarantee absolute isolation. Do not store sensitive personal data, credentials, or secrets through the agent chat interface.

10. Modifications

We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
